5 Ways to Avoid Probate in Texas

Probate is not always the nightmare people imagine, but it does involve time, costs, and public court records. If you would prefer that your assets pass directly to your loved ones without going through probate, Texas offers several effective strategies.

1. Beneficiary Designations

The simplest way to avoid probate for certain assets is to name a beneficiary directly on the account. When you name a beneficiary, the asset passes directly to that person upon your death — completely outside of probate.

Assets that commonly allow beneficiary designations include:

  • Life insurance policies
  • Retirement accounts (401k, IRA, 403b)
  • Bank accounts (payable-on-death)
  • Brokerage and investment accounts

Important: Review your beneficiary designations regularly. Outdated designations — naming an ex-spouse, a deceased person, or no one at all — are one of the most common estate planning mistakes we see.

2. Transfer-on-Death Deeds and Lady Bird Deeds

For real property (your house, land, or investment properties), Texas offers two powerful tools:

Transfer-on-Death (TOD) Deed

Texas authorized transfer-on-death deeds in 2015. A TOD deed allows you to name a beneficiary who will automatically receive the property when you die. During your lifetime, you retain full ownership and can sell, mortgage, or revoke the deed at any time.

Lady Bird Deed (Enhanced Life Estate Deed)

A Lady Bird deed gives you a life estate in the property with the power to sell, mortgage, or lease the property without the beneficiary's consent. Upon your death, the property passes automatically to the named beneficiary.

Both types of deeds can be prepared by a probate attorney for a modest flat fee.

3. Joint Ownership with Right of Survivorship

When two or more people own property as "joint tenants with right of survivorship," the surviving owner(s) automatically receive the deceased owner's share upon death.

In Texas, the right of survivorship must be explicitly stated in writing. Texas does not presume right of survivorship just because two names are on a deed or account.

Caution: Joint ownership has risks. The co-owner has immediate access to the asset, which can be problematic in blended families or if the co-owner has creditor issues or goes through a divorce.

4. Payable-on-Death and In-Trust-For Accounts

For bank accounts, CDs, and brokerage accounts, you can add a payable-on-death (POD) or transfer-on-death (TOD) designation. The account owner maintains full control during their lifetime, and the named beneficiary receives the funds upon death — no probate required.

Setting up a POD designation is usually as simple as filling out a form at your bank. There is typically no cost, and you can change the designation at any time.

5. Revocable Living Trust

A revocable living trust is the most comprehensive probate-avoidance tool available. It works by transferring ownership of your assets from your name into the name of the trust during your lifetime. You serve as the trustee and maintain full control.

Advantages of a living trust:

  • Avoids probate for all assets held in the trust
  • Keeps your estate completely private (no public court records)
  • Provides for incapacity management
  • Can protect assets across multiple states

Critical point: A trust only avoids probate for assets that have been properly "funded" (transferred into the trust). Creating a trust but never transferring your assets into it is one of the most expensive mistakes in estate planning.
