A Transfer on Death Deed lets you name a beneficiary for your home. While you are alive, the deed has no effect — you keep full ownership, you can sell the property, refinance it, or revoke the deed at any time. But when you pass away, the property automatically transfers to your named beneficiary without probate. It is one of the simplest and most cost-effective estate planning tools available in Texas.
Lady Bird Deed (Enhanced Life Estate Deed)
A Lady Bird Deed works similarly to a TODD but with some additional benefits. You retain a "life estate" in the property, meaning you keep full control during your lifetime — including the right to sell, mortgage, or lease the property without your beneficiary's permission. At your death, the property passes automatically to your named beneficiary. Lady Bird Deeds are particularly popular for Medicaid planning because the property generally does not count as a transfer that would trigger a Medicaid penalty period.
